Washington D.C. – Following today’s Senate confirmation of Nicole Berner to a seat on the 4th Circuit Court of Appeals, People For the American Way President Svante Myrick released the following statement:

We are overjoyed by today’s confirmation of Nicole Berner, whose brilliance, experience, and commitment to justice will make her a truly outstanding federal judge.  Congratulations to President Biden and Maryland Senators Cardin and Van Hollen for the nomination and to Senator Schumer and Senator Durbin for moving this nomination forward.

“Nicole Berner is one of those selfless people whose passion is helping others. As an attorney she represented workers at SEIU and defended reproductive rights at Planned Parenthood. Before she began her law career, she helped establish an organization for Israeli women who suffered violence and led workshops on democracy for Arab and Jewish children. She will be the first Jewish judge on the 4th Circuit in many decades and the first out LGBTQ+ judge to join that circuit.

“Her confirmation underscores the importance of continuing to confirm President Biden’s judicial nominees. We are excited that the Berner confirmation is the ninth in the past three weeks. But there is more work to do, including confirming excellent nominees like Adeel Mangi, nominated to the 3rd Circuit, who are continuing to await a Senate vote. These confirmations are critical steps toward rebalancing our courts with fair-minded jurists committed to equal justice for all.  Our rights, our health, and our freedom all depend on Senate Democrats continuing to prioritize judicial confirmations in these final months of the president’s first term.”
