Even as the Senate confirmed its last Biden judges, previously confirmed Biden judges continued to cast important votes in cases in December. There were seven such decisions in December, including a significant ruling blocking a large grocery store merger that would have violated antitrust laws, an important holding on the scope of the Family and Medical Leave Act, and decisions on sex discrimination, gun safety, voting rights, and other issues.

Such rulings by Biden judges demonstrate the importance to all of us of nominating and confirming fair-minded federal judges.
As we anticipate action by the Republican-controlled Senate to confirm more Trump nominees to our federal courts beginning this year, it is important to recognize the progress that the Biden White House and Senate Democrats made in helping to rebalance the federal judiciary with judges who will remain on the courts for life. As of December 31, the Senate confirmed 235 Biden judges, one more than the 234 Trump nominees confirmed in Trump’s first term. Although several Biden court of appeals nominees remained on the Senate floor and did not receive votes, significant progress was clearly made.
